In just 145 days the EU will be voting on whether to implement new Europe wide Data Protection legislation. If passed this will be the most strict, restrictive and invasive data protection legislation ever seen.
This legislation will affect nearly EVERY business and will decimate large swathes of the UK marketing industry. Your ability to market your company or organisation will be seriously affected. It you use, manage, store data (everyone does!) are an SEO company, use Google Analytics, provide marketing or sales services, you WILL be affected.
The DMA are leading the charge in fighting this oppressive legislation and we would urge you to write to your MEP to protest at the proposed changes.
If you think that the legislation will not affect you, just look at some, but by no means all, of the proposed changes.
Online marketing
- Analytics become impossible as tracking of IP addresses is banned
- Profiling is practically prohibited without the explicit consent of the consumer
Email marketing
- No tracking data allowed without explicit consent, making effectiveness extremely difficult and unreliable to measure
- Profiling and segmentation will become difficult and patchy
- Tailored content will be hard to target and harder still to measure
Social media
- Marketing can no longer be targeted based on profiling
- Campaigns can only be analysed by the most basic measures; demographic analysis won't be possible
Mobile marketing
- Profiling information can't be used to target messaging
- No tracking data allowed without explicit consent, making effectiveness extremely difficult and unreliable to measure
Data industry
- Data will become impractical and expensive both to source and keep up-to-date; making it extremely difficult to form an accurate picture of your marketplace
- Legacy data might be required to comply with new regulation, raising the spectre that prospect lists could be decimated
- List broking severely restricted
Direct mail
- Move from opt-out to opt-in: explicit consent needed to send any message to any recipient, with the exception of existing customers
- Existing databases may not be usable under regulation: could decimate prospect lists
- Demographic information will have to be wiped
Telemarketing
- Move from opt-out to opt-in
- No cold calling to prospective customers
- No profiling or segmentation without individual consumer's consent

The Mail Online today reported that two men who have sent unsolicited 'spam' texts may face a £250,000 fine from the Information Commissioner.
This is the first case and prsecution and is part of a crackdown by authorities to halt the wide spread abuse of bulk spam trying to identify individuals who have been involved in an accident, or mis-sold PPI insurance. The scam involved generating mobile phone numbers at random and seen which people responded. These details were then sold on to third party companies to make unsolictied calls.

On April 20th the ICO welcomed new powers to fine organisations for unwanted marketing calls and messages
The Information Commissioner has welcomed new powers to serve monetary penalties of up to £500,000 for the most serious incidents of businesses and other organisations making unwanted marketing phone calls or sending unwanted marketing emails to consumers.
The change – along with other powers granted to the ICO - will come into force as part of an amendment to the UK’s Privacy and Electronic Communications Regulations (PECR) on 25 May 2011.
The new powers, which have been confirmed by the Department for Culture, Media and Sport, will include:
* Monetary penalty powers extended: the Information Commissioner can serve a monetary penalty of up £500,000 for the most serious breaches of PECR. This covers businesses and other organisations sending unwanted marketing emails and texts, as well as making live and automated marketing phone calls.
* Increased investigatory powers: the Information Commissioner can require telecommunications companies and internet service providers (ISPs) to provide his office with information that he needs to investigate breaches of the Regulations.
* Compulsory notification when breaches occur: telecommunications companies and ISPs will be required to notify the ICO and their customers in certain circumstances when a personal data breach occurs.
* Increased audit powers: the Information Commissioner will have the power to audit telecommunication companies and ISPs for compliance with these personal data breach notification requirements.
* New rules for websites using cookies and similar technologies: the ICO will be responsible for regulating compliance with this new requirement and will soon be issuing advice.
Information Commissioner, Christopher Graham, said:
“The ICO has been calling for increased powers to regulate breaches of PECR for some time. The changes to the Regulations will grant us the right to impose significant monetary penalties for the most serious breaches of the rules and give us improved powers to investigate companies that make nuisance marketing calls.
“The new powers are coming into force on 25 May. The Information Commissioner's Office will be issuing guidance to reflect the changes that are being introduced.”
